PRIVACY POLICY

 

LANGUAGE B is a branded language learning system provided and serviced by Language B, Inc. and primarily conceived as a web-based language learning system. Language B, Inc. is committed to complying fully with the Children’s Online Privacy Protection Act of 1998. Our information collection practices are described below. We urge everyone under the age of 18 to check with their parents before entering information on any website, and we urge parents to discuss with their children restrictions regarding the online release of personal information to anyone they don’t know.  Our primary web portal/domain is LanguageB.com and reference to this domain are intended to refer to all web portals/domains owned or operated in whole or in part by Language B, Inc. unless otherwise indicated in the privacy policies of those related websites.  We may utilize additional domain names as needed for affiliated websites in English or other languages or to comply with local or regional laws and regulations.  This privacy policy applies to all LANGUAGE B websites regardless of the domain.  This privacy policy does not apply to third-party websites which may be accessed via LanguageB.com.

 

What Information Is Collected?

 

At LanguageB.com, it’s our intention and policy to create website content that requires minimum collection of information from our visitors. Generally, we strive to limit our collection of personally identifiable information from children and adults to the minimum required to verify user identity, to track user progress, and to authenticate subscriptions.

 

Personal information may be collected for the following purposes:

 

1. Providing subscription and support related services on the website (hereinafter called the "Online Services") to subscribers and users, and for conducting related activities;

 

2. Processing of subscriptions (i.e. persons and entities responsible for the account) and enrollment of users (i.e. students) for Online Services;

 

3. Responses to inquiries and complaints;

 

4. Efforts to design and improve the Online Services for subscribers and users, including through sending questionnaires to customers (no personal information collected thereby will be disclosed to any third parties);

As explained below, we also collect information of various kinds from employers and legal guardians of users (e.g., credit card and billing information, e-mail addresses, home addresses, etc.) when they purchase products and services at our site.

 

In accordance with the Children’s Online Privacy Protection Act of 1998 (COPPA), we require verifiable parental consent to the collection, use, or disclosure of information collected from or about children under the age of 13.

 

Information collected about subscribers and users (including children) may include names, address, phone numbers, subscriber’s credit card information, purchase and subscription history, and (when relevant) the name and contact information of a legal guardian.  Information about your usage of the site may be gathered for analytical purposes and to enhance your online experience.

 

Information we may collect and analyze includes, but is not limited to, the internet protocol (IP) address used to connect your computer to the Internet; email address; computer and connection information such as browser type and version, operating system, and platform; the connection to, through, and from our Web site, including date and time; cookie number and products you viewed or searched for.

 

 

Providing Information to Third Parties

 

We will not provide your personal information to any third party without your advance consent, except where such disclosure:

 

1. Is in accordance with or required by applicable law;

 

2. Is necessary for the protection of the safety or property of our users or the public, and it is difficult or impractical to obtain the consent of the individual;

 

3. Is necessary for public health or education and it is difficult or impractical to obtain the consent of the individual;

 

4. Is made in cooperation with national or local authorities, or an individual or entity appointed by such authorities to enforce the law or carry out legal process, and in which seeking the consent of the individual could affect such enforcement or legal process; or

 

5. Is made pursuant to a merger, acquisition or other business combination.

 

We may disclose aggregate information regarding users (without personally identifiable information) to third parties that we believe to be reputable. Please also see "About Cookies and Log Data" below.

 

If we entrust an individual or entity with the handling of any personal information, we will exercise necessary and appropriate supervision over such individual or entity to ensure the security of such personal information.

 

 

Ordering from the Site and Opening an Account

 

When subscribers make purchases through LanguageB.com (e.g., subscription services to the website or downloadable content), they are required to provide their full name, billing address, shipping address (when relevant), e-mail address, credit card number/expiration date/ccv code and a phone number associated with the credit card used. If customers do not complete the order process (e.g., fail to enter a valid credit card number/expiration date, or fail to complete a purchase transaction) the information submitted during the order process will not be captured by our system. Once a customer has successfully entered a valid credit card number/expiration date/ccv code and completed the order process, an account will be created and maintained for that customer pursuant to the websites Terms and Conditions. We use this information to process the customer’s order and to send order confirmations via e-mail. We do not sell, transfer or share the information with third parties, except when the information is transferred, disclosed and shared with a third-party agent who uses the information solely to handle and manage fulfillment and customer service. All third-party agents are prohibited to use the information for other purposes, and all third-party agents have agreed to maintain the confidentiality of such information.

 

LanguageB.com does not sell products or services for purchase by children. Because it may be illegal for Language B, Inc. to enter into a contractual relationship with minors in many jurisdictions, all Language B products and services are intended for purchase by adults who, at their sole risk and discretion, may purchase and provide or Language B services and products for use by minors.

 

If you are under 18 you must obtain the permission of a parent or guardian who must then agree to our Terms and Conditions of use and to whom a revocable limited license shall be granted.

 

 

Customer Service

 

LANGUAGE B subscribers and users may e-mail us whatever questions they may have about the website, educational content and offerings, our information collection policies, and user and subscriber procedures and subscription services. E-mails containing language deemed threatening or offensive may be filtered out and/or deleted prior to reading by Language B staff and may also be forwarded to law enforcement or legal counsel if deemed necessary.  The communication of any actual or perceived threat to any Language B, Inc. employee will result in immediate termination of your account with no refund available.

 

Other than an e-mail address, we do not request that users submit any personal information online for customer service unless you desire further contact by telephone. We may, however, ask for additional non-personal information to better help us respond to customer service questions. We use the e-mail address to communicate directly with customers about technology-related questions and provide them with answers that they may find helpful. We do not sell, transfer or share the e-mail address with third parties, with the exception that the information is transferred, disclosed and shared with a third-party agent who uses the information solely to handle and manage customer service, but cannot use it for other purposes, and has agreed to maintain the confidentiality of such information.

 

 

Regulation of Internet Communication by Various Government Authorities

 

In some jurisdictions, e-mail communications are subject to review by various government agencies and may be subject to laws and regulations governing their content which could result in the communication not being received by us and could further result in penalties including, but not limited to, fines and/or imprisonment.  Language B, Inc. cannot guarantee that e-mail communications will not be read by your government authorities and encourages you to comply with all laws and regulations relating to such communications.  Users and subscribers assume all risk associated with the content of electronic communications they send or cause to be sent to Language B, Inc.  Language B wants you to have a safe and productive learning experience and encourages responsible use of internet based communications.  No website can guarantee that your online experience is not being monitored by government authorities, so it is prudent to act accordingly.  Subscribers and users are responsible to familiarize themselves with their jurisdiction’s specific laws and regulations regarding electronic communications.

 

 

Use and Disclosure of Information

 

LanguageB.com uses or may use personally identifiable information that our customers provide for such purposes as responding to their questions regarding our products and services. LanguageB.com currently does not disclose to third parties personally identifiable information that adults or children provide, except from time to time we may transfer, disclose or share such information with third-party agents who may be engaged by us specifically to handle and deliver services. Such third parties have access to personal information needed to perform their functions, but may not use it for other purposes. Additionally, in the event that all or substantially all of the assets in relation to LanguageB.com are transferred or sold to another entity, personally identifiable information submitted to us may be transferred to the acquiring entity. Finally, we may also disclose personally identifiable information to third parties in order to comply with various laws or requests by law enforcement agencies, to enforce our website and subscription Service Terms and Conditions, or to protect the rights, property or safety of our website, users of our website and others.

 

 

About Cookies and Log Data

 

Cookies are information files that your Web browser places on the hard drive of your computer when you visit a website. Cookies cannot damage user files, nor can they read information from a user’s hard drive. Cookies allow websites to “remember” users’ activities on a website as well as users' visits to a site. At LanguageB.com, cookies are used to determine the number of unique visitors to our website over a period and to remember user screen names so that the need for multiple logins is eliminated. We do not store any personal information in cookies, nor do we link or combine information collected through cookies to any personal information that children or adults submit online when participating in our services. You may disable cookies on your computer by indicating this in the Preferences or Options menu in your browser.

 

Third-party ads, if any, appearing on LanguageB.com are delivered to you by a third-party ad service provider. In the course of serving ads, the ad service provider may place or recognize its own unique cookie on your browser, and may use non-personally identifiable information about your visit to LanguageB.com, such as the number of times that you viewed an ad. Log data collected on Web servers both within LanguageB.com’s control and under the control of any third-party ad service provider, who is required to maintain such data on a confidential basis, supplies LanguageB.com with aggregate information about the number of visits to different pages on our site.

 

LanguageB.com uses such aggregate information to improve access to our content based on our visitors’ browsers and operating system types and make our content available to as many customers as possible. We do not link the log data we collect to the personal information that adults or children submit online when participating in our services.

 

 

Parental Access

 

At LanguageB.com, our goal is to ensure parents that their children have a safe online experience. That’s why we’ve set up a system by which parents can print out and mail or fax to us a signed form that allows them to review any identifiable information collected about their child, have this information deleted, and/or request that there be no further collection or use of their child’s information. LanguageB.com takes steps to verify the identity of anyone requesting information about a cardholder and to ensure that the requester is in fact the customer or the child’s parent or legal guardian.

 

 

Security

 

LanguageB.com has taken steps to ensure that personally identifiable information collected in the future is secure, including limiting the number of people who have physical access to our database servers, as well as electronic security systems and password protections that guard against unauthorized access.

 

LanguageB.com provides a warning when linking from our site to an advertiser’s site, which lets our users know they are going to an advertiser’s site and reminds minors not to give out information online without permission from a parent or guardian.

 

 

Amendments to the Privacy Policy

 

We may amend this Privacy Policy at any time. If we make any material changes in the way we collect, use, and/or share your personal information, we will notify you by sending you an e-mail at the last e-mail address that you provided us, and/or by prominently posting notice of the changes on the websites covered by this Privacy Policy. Any material changes to this Privacy Policy will be effective upon the earlier of thirty (30) calendar days following our dispatch of an e-mail notice to you or thirty (30) calendar days following our posting of notice of the changes on the websites covered by this Privacy Policy. Please note that, at all times, you are responsible for updating your personal information to ensure we have your current e-mail address.
